These terms govern your use of the ZTrack website (ztrack.fr), the ZTrack API (api.ztrack.fr) and the ZTrack desktop application (collectively, the "Service"). By creating an account, signing in or installing the desktop app you agree to these terms. If you do not agree, do not use the Service.
You must be at least 16 years old, or the age of digital consent in your jurisdiction (whichever is higher), to create an account. Business accounts may only be created by a person authorised to bind the legal entity they represent.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at contact@ztrack.fr if you suspect unauthorised access. We may suspend or terminate accounts that violate these terms, infringe third-party rights, or are used to abuse the Service (e.g. license-key sharing beyond the per-seat allowance).
The Free plan is provided at no cost. Paid plans (Premium, Pro, Business) are billed annually in advance through Stripe. Prices are displayed in EUR including EU VAT for consumer customers; business customers see prices excluding VAT and receive an invoice with their VAT number where applicable (Stripe Tax handles the calculation). By subscribing you authorise Stripe to charge the same amount on each anniversary date until you cancel.
You may cancel auto-renewal of any subscription at any time from your account dashboard or by emailing us. Cancellation takes effect at the end of the current billing period; you keep access to paid features until that date. All sales are final and non-refundable. The 14-day cooling-off period under EU consumer law (Directive 2011/83/EU) does not apply because you expressly request immediate access to digital content upon checkout, and we make this exception clear at the point of purchase. If a paid feature is removed from the Service during your subscription, you may request a pro-rata refund for the remainder of the period.
ZTrack is a desktop application. Even after your subscription ends, the version of the desktop app you installed continues to work — it falls back to the Free plan limits but every project file you saved remains yours and openable forever.
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the desktop application on the number of devices permitted by your plan (1 for Premium, 10 for Pro, 200 for Business). Sub-licensing, redistribution, reverse engineering, modifying or decompiling the binary is prohibited except where such restriction is unenforceable under applicable law (e.g. interoperability under EU Directive 2009/24/EC).
You retain all rights, title and interest in the video footage, telemetry data and project files you process with ZTrack. We do not upload, store or analyse your media — everything happens locally on your machine. You grant us no license over your content because we never receive it.
You agree not to: (a) use the Service to violate any law; (b) infringe third-party intellectual-property or privacy rights; (c) reverse engineer or attempt to bypass the license enforcement of the desktop application; (d) abuse the API by exceeding documented rate limits or by automating account creation; (e) use the Service to create content that is unlawful, defamatory, harassing, or that infringes our or third parties' rights.
The Service integrates with Stripe (payments + Stripe Tax), Google OAuth (optional sign-in), Google AdSense (optional advertising on the marketing site and in the Free-plan pre-roll), OpenStreetMap and other tile providers (map overlays), and OVHcloud (hosting). Your use of those services is governed by their respective terms and privacy policies.
We aim for high availability of the API but do not warrant uninterrupted operation. Scheduled maintenance is announced on the status page. Because the desktop application performs all editing offline, an API outage does not prevent you from editing or exporting — only license activation, sign-in and auto-update temporarily fail.
The Service is provided "as is" and "as available". To the maximum extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will meet your requirements, be error-free or operate without interruption.
To the maximum extent permitted by law our total liability under these terms is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, special or punitive damages, or for loss of profits, revenue, data or goodwill. Nothing in these terms excludes liability for fraud, gross negligence, death or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.
You agree to indemnify and hold us harmless from any claim, demand or damage arising from your use of the Service in violation of these terms, your content, or your violation of third-party rights.
We may modify the Service to add, remove or change features. Material changes to these terms are announced 30 days in advance via email to active subscribers and a banner on the marketing site, with the "Last updated" date at the top of this page reflecting the latest revision. Continued use of the Service after the effective date constitutes acceptance of the revised terms. If you do not accept the changes, you may cancel your subscription before the effective date and obtain a pro-rata refund for the remaining period.
You may terminate your account at any time by deleting it from the dashboard. We may terminate your account for material breach of these terms with 30 days' notice (or immediately for serious breaches such as fraud, illegal use, or repeated abuse). Upon termination your access to paid features ends; the desktop application falls back to Free-plan limits and your project files remain yours.
These terms are governed by French law, without regard to conflict-of-laws rules. Disputes are subject to the exclusive jurisdiction of the courts of Paris, France, except where mandatory consumer-protection laws of your country of residence grant you the right to bring proceedings before a court closer to you.
